Babb RV Rentals LLC – Terms and Conditions (Texas)

These Terms and Conditions (“Agreement”) govern the rental of recreational vehicles (RVs)
from Babb RV Rentals LLC (“Company,” “we,” “our,” or “us”), a Texas Limited Liability
Company. By reserving, signing, or using our RVs, you (“Renter,” “you,” or “your”) agree to
these legally binding terms.

1. Eligibility

  • You must be at least 25 years old with a valid U.S. driver’s license.

  • You must carry active automobile liability insurance compliant with the Texas Motor Vehicle Safety Responsibility Act (Texas Transportation Code Chapter 601).

  • International renters must provide a passport and valid international driver’s permit.
     

2. Reservations and Payments

  • A non-refundable reservation deposit of (Dependent on unit) is required to secure a booking.

  • Full payment is due no later than [e.g., 14 days] prior to pick-up.

  • Acceptable payments include major credit cards, debit cards, and bank transfers.

  • A refundable security deposit of (Dependent on unit) is required and held for damage, cleaning, fuel, mileage overages, etc.

3. Cancellation Policy (Texas)

  • More than 30 days before rental: Full refund minus reservation fee.

  • 15–30 days before rental: 50% refund.

  • Less than 15 days: No refund.

  • No-shows or early returns: No refund.

Note: In compliance with the Texas Deceptive Trade Practices Act (DTPA), we will act in good faith for cancellations due to emergencies or vehicle unavailability.

4. Pick-Up / Return

  • RVs must be picked up and returned at designated times and locations.

  • Late returns are subject to a $35 per hour fee. If returned after 5 pm another day will be added to rental. Returns over 24 hours late without notice may be considered vehicle theft under Texas Penal Code § 31.07.

  • Renter must notify us of delays as soon as possible.

5. Use Restrictions
The RV may not be:

  • Used for illegal purposes (as per Texas Penal Code)

  • Operated off-road or on unpaved surfaces

  • Driven outside the continental U.S. or Canada without written permission

  • Used to tow, carry passengers for hire, or as a residence (unless expressly permitted)

  • Operated under the influence of alcohol, drugs, or medications that impair driving

6. Pets and Smoking

  • Smoking/vaping is strictly prohibited. Cleaning fees start at $250 if detected.

  • Pets are allowed with written approval and a fee of $30.

  • Renter is liable for any pet-related damage.

7. Vehicle Condition and Return Requirements

  • RVs are provided clean, fueled, and inspected.

  • You are required to return the RV:

    • With full fuel

    • With empty waste/holding tanks (Unless Dump Fee is Paid)

    • In clean condition inside and out

  • Cleaning or dumping fees will apply for non-compliance.

8. Breakdowns and Emergency Procedures

  • We offer [basic/premium] roadside assistance through [Provider].

  • Notify Babb RV Rentals LLC immediately of any breakdown or accident.

  • f involved in a collision, a police report is required per Texas Transportation Code § 550.026.

  • Refunds for mechanical issues unrelated to misuse are capped at $[insert amount]/day.

9. Maintenance and Repairs

  • Renter is responsible for daily maintenance checks (oil, tires, fluids).

  • Unauthorized repairs are not reimbursable.

  • Mechanical failure due to neglect will be fully charged to Renter.

10. Insurance and Liability (Texas)

  • Renter must show proof of active auto liability insurance.

  • Owner provides minimum liability coverage as required by Texas law.

  • Renter is financially responsible for:

    • Collision damage

    • Vandalism or theft

    • Damage to tires, awnings, and undercarriage

    • Loss of income during repair (if applicable)

11. Security Deposit

  • Held for 7 business days post-return per Texas Property Code § 92.103.

  • Deductions may be made for:

    • Damage

    • Excessive cleaning

    • Late returns

    • Overage mileage/generator use

​

12. Mileage and Generator Use

  • Daily mileage allowance: ___ miles/day

    • Overage charge: $___/mile

  • Generator use: 8 hours/day included

    • Overage charge: $5/hour

​

13. Indemnity and Hold Harmless Clause
You agree to indemnify and hold harmless Babb RV Rentals LLC, its owners, employees, and agents from any claims, damages, or liabilities arising out of your rental use, except in cases of Owner’s proven negligence or willful misconduct.

14. Termination and Repossession
We reserve the right to cancel or terminate this rental without notice if:

  • Renter violates any of these terms

  • RV is misused or endangered

  • Payment is delinquent

​

In such cases, the vehicle may be repossessed without a court order under Texas Business & Commerce Code § 9.609.

​

15. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of Texas. Any disputes will be resolved in the appropriate court located in [Insert County] County, Texas.

16. Entire Agreement
This document contains the entire agreement between the parties. No oral representations or prior agreements shall modify these terms unless agreed to in writing.
